1. Scope

These Terms and Conditions (T&Cs) govern the use of the services, facilities, and premises of Manegg Motion AG. The membership agreement itself is concluded through the membership management system. These T&Cs supplement the membership agreement and, together with the Code of Conduct and House Rules, form the contractual basis between the member and Manegg Motion AG.

2. Services

Manegg Motion operates a premium neighbourhood fitness studio offering strength training, functional training, Pilates Reformer, body composition analysis, personal training, and related health and fitness services.

The scope of services available to each member depends on the membership selected.

3. Membership Term and Renewal

Membership is concluded for the agreed minimum contract term.

Unless otherwise expressly agreed, the membership will automatically renew for the same duration as the original contract term unless terminated in writing at least three (3) months before the end of the current term.

Written notice includes both postal mail and email.

4. Cancellation and Goodwill Policy

As a general rule, there is no statutory right of withdrawal for fitness memberships under Swiss law.

For memberships concluded online, Manegg Motion voluntarily grants a withdrawal period of seven (7) calendar days from the date of contract conclusion, provided that the studio has not yet been used and no access has been granted.

5. Membership Freeze

A membership freeze may be granted in cases including, but not limited to:

  • illness,
  • accident,
  • pregnancy,
  • medical prohibition from training,
  • extended stay abroad,
  • or other comparable important reasons.

 

Supporting documentation (e.g. a medical certificate or official confirmation) must be provided upon request.

During the freeze period, membership rights are suspended. The frozen period will be added to the end of the membership term.

No refunds of membership fees will be made.

The maximum freeze duration is generally six (6) months per contract year. In justified exceptional circumstances, Manegg Motion may, at its sole discretion, grant a freeze of up to twelve (12) months.

6. Access

Access to the studio is provided through a personalised access system.

Memberships are personal and non-transferable. Sharing access credentials or allowing unauthorised individuals to enter the premises is prohibited.

Misuse may result in the immediate suspension of access rights.

7. Opening Hours and Unstaffed Hours

Current opening hours are communicated by Manegg Motion.

During unstaffed hours, members train entirely at their own responsibility. No continuous supervision by Manegg Motion staff is provided during these periods.

8. Health and Personal Responsibility

By entering into a membership agreement, members confirm that they are medically fit to participate in the training and fitness activities offered.

Members with health concerns are advised to seek medical advice before commencing training.

Members are solely responsible for ensuring their own fitness to participate.

9. Safety and Equipment Use

Training equipment and facilities must be used properly and in accordance with staff instructions.

Pilates Reformer equipment may only be used after appropriate instruction or induction.

All safety instructions issued by staff must be followed at all times.

10. Hygiene

Members must comply with all applicable hygiene requirements.

In particular, members are required to:

  • wear appropriate training attire,
  • use a personal towel,
  • clean equipment after use,
  • leave facilities clean and tidy.
11. Data Protection and Video Surveillance

Personal data is processed in accordance with the Swiss Federal Act on Data Protection (FADP/DSG) and the current Privacy Policy of Manegg Motion AG.

For security, access-control, and property protection purposes, selected areas of the studio may be monitored by video surveillance.

Changing rooms, showers, and sanitary facilities are not subject to video surveillance.

12. Late Payment

Membership fees are due in accordance with the agreed payment terms.

In the event of non-payment, Manegg Motion reserves the right to suspend studio access until all outstanding amounts have been settled in full.

Reminder fees, collection costs, and other reasonable expenses associated with debt recovery may be charged to the member.

13. Liability

All facilities and services are used at the member’s own risk.

To the extent permitted by law, Manegg Motion shall only be liable for damages caused by intentional misconduct or gross negligence.

Manegg Motion accepts no liability for loss, theft, or damage to clothing, valuables, vehicles, or any other personal property belonging to members.

14. House Rules and Sanctions

Manegg Motion exercises domiciliary rights over its premises.

Violations of these T&Cs, safety regulations, staff instructions, the Code of Conduct, or the House Rules may result in measures including:

  • warning,
  • temporary suspension,
  • exclusion from training activities,
  • extraordinary termination of membership.

No refund of fees already paid shall be granted in such cases.

15. Permanent Inability to Train

In cases of permanent inability to train or comparable serious circumstances, Manegg Motion may, after reviewing the individual situation, grant an extraordinary termination of the membership agreement.

Members have no automatic entitlement to such termination.

16. Final Provisions

Should any provision of these Terms and Conditions be found to be invalid or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected.

These Terms and Conditions are governed exclusively by Swiss law.

The exclusive place of jurisdiction for all disputes arising out of or in connection with the membership shall be Zurich, Switzerland, unless mandatory legal provisions provide otherwise.

Welcome to Manegg Motion.

Manegg Motion is more than a fitness studio. We are creating a high-quality training environment for the Manegg community – a place where people treat each other with respect, take responsibility, and enjoy training together.

To ensure that all members can enjoy a safe, welcoming, and motivating training experience, we ask everyone to follow the principles below.

1. Respect the Space

Please treat our studio, equipment, and facilities with care.

We expect all members to:

  • Return weights, accessories, and equipment after use
  • Use equipment carefully and as intended
  • Report any damage or defects immediately
  • Leave training areas clean and organized
  • Avoid unnecessary noise and intentionally dropping weights

 

We strive to create a calm, high-quality, and enjoyable training environment – thank you for helping us maintain it.

2. Respect Others

Everyone trains differently – and everyone deserves respect.

At Manegg Motion, we expect members to:

  • Treat fellow members and staff with respect
  • Share equipment fairly, especially during busy periods
  • Avoid unnecessarily occupying equipment or training areas
  • Respect personal boundaries and different fitness levels
  • Contribute to a positive and welcoming training culture

 

Harassment, discrimination, intimidation, or aggressive behaviour will not be tolerated.

3. Train Clean

Cleanliness and hygiene are essential parts of a high-quality training experience.

We expect all members to:

  • Use a towel during training
  • Clean equipment after use
  • Wear clean workout clothing
  • Use appropriate indoor training shoes
  • Respect cleanliness and hygiene standards in changing rooms and wet areas

 

A clean studio is everyone’s responsibility.

4. Access & Security

Your membership is personal.

For security reasons:

  • Access is strictly personal and non-transferable
  • Allowing unauthorized individuals to enter the studio is prohibited
  • App credentials, access badges, or login details must not be shared
  • Tailgating (allowing unauthorized persons to enter with you) is not permitted
  • Suspicious or safety-related situations should be reported immediately

 

To protect our members and facilities, selected areas may be monitored by video surveillance. Further information can be found in our Privacy Policy.

5. Train Responsibly

Train mindfully and within your capabilities.

Please:

  • Use equipment only as intended
  • Follow all safety instructions
  • Ask for assistance if you are unsure
  • Avoid unnecessarily risky behaviour
  • Use appropriate safety precautions for heavy lifts and exercises

 

Pilates Reformer equipment may only be used after appropriate instruction.

During unstaffed hours, members train at their own responsibility.

6. Community Before Ego

Manegg Motion is built on trust and mutual respect.

7. Consequences of Violations

To protect our community and training environment, Manegg Motion may take appropriate action in response to repeated or serious violations of these guidelines.

Such measures may include:

  • Verbal warning
  • Written warning
  • Temporary suspension of studio access
  • Termination of membership

 

Serious misconduct – including safety violations, misuse of the access system, intentional damage to facilities, harassment, or disrespectful behaviour towards members or staff – may result in immediate exclusion from the studio.
